Philosophic Exploration Of Philosophy Of Law In Contemporary China

Philosophy is the subject of human wisdom and the elite of time spirit. So the philosophy of law should be the subject of human wisdom in law and the elite of time spirit of law. Confronting with the opportunity and challenge in the new century, the philosophy of law in China needs to develop.That the title of this dissertation is chosen to be Philosophic Exploration of Philosophy of Law in Contemporary China is based on the following viewpoint of the author: Philosophic theory is the soul of philosophy of law reflecting its quality. The prominent problems of philosophy of law in China are short of philosophy, quality and guidance power. And the philosophic exploration and construction of philosophy of law, which is belong to jurisprudence but not the same as jurisprudence, is the contemporary mission and impending task of philosophy of law in contemporary China.This dissertation attempts to combine the new achievement in Marxist philosophy with the theoretic elevation and construction of philosophy of law. It aims to take a basic and perspective probe into the logos and liberal spirit that philosophy of law in China should conform to and the main tasks of the construction of philosophy of law in China to increase theoretic motivity for the research of philosophy of law in China. The goal is to elevate the theoretic quality, boost the adaptation to the challenge in the new century, and the guidance power of philosophy of law.This dissertation is composed of the following four parts: First part is Review of Jurisprudence in China in the Past Century, in which the relations and revelation of history about the development of philosophy of law are got by way of analysis of the history of jurisprudence in China. Second part is Thinking of Reality of Philosophy of Law in China, in which the mainproblem lacking philosophy and its causes are pointed and the mission of Philosophic Construction and its countermeasures are put forward by way of the analysis of the reality of philosophy of law in China. Third part is Guidance Resources of Philosophic Theory to Construct Philosophy of Law in China. In this part, theoretic resources of philosophy of law are mined by way of the analysis of Marxist philosophy and the revolution of philosophy of law to find theoretic guidance, base point and nutrition for the Philosophic Construction of philosophy of law in China. Fourth part is Primary Attempt of Philosophic Exploration of Philosophy of Law in China. In this part, a group of theoretic and practical topics about law with great influence in the new era is analyzed in deep to get experiences and methods, based on which the primary design to construct the system of philosophy of law in China is put forward.
