Foreign Law Exploration Of The Song Dynasty

The division of labour in the academic circles shared out the Law and the History in two fields. So the study in the laws concerning foreign affairs in Song Dynasty is so little that this thesis tries to do the tentative study to fill this gaps.The thesis consists of five chapters.Chapter One "introduction", mainly illustrates the academic value and realistic magnificence of studying in the laws concerning foreign affairs in Song Dynasty. Meanwhile, on the basis of the research history of this subject, this thesis will adopt the method of systematic inspect and comparative in studying on the subject.Chapter Two inspects the external policies and the developments of foreign relations in the Song Dynasty. The first section inspects the tolerant policy of the Song Dynasty. Because of the great changes of the internal and external situations, the external policy of the Song Dynasty had a concentration in political relations, but its overseas trade had a big development. On the basis of the policy, the foreign relation of Song Dynasty had developed very much in general and ngovernmental aspects.Chapter Three is inspection of the laws concerning foreign affairs of the Song Dynasty. The thesis classifies the laws according to official capacity, nongovernmental capacity and the people who submited to the authority of Song. With regard to the laws concerning the official people coming to China, the thesis inspects the acceptance, the grade and the right who can enjoy of this part of people. With regard to the laws concerning the nongovernmental people, the thesis inspects the civil laws, the economic statutes, the criminal law and the procedural law concerning foreign affairs. With regard to the people who submited to the authority of Song, the thesis inspects the settlement,the marriage,and so on.Chapter Four is inspection of the laws concerning foreign affairs of the Song Dynasty itself.
