The Non-state-owned Unmovable Cultural Relics:the Contradiction Between Private Or Collective Interest And Public Management And Policy Issues

Non-state-owned unmovable cultural relics,as an important part of our country’ s cultural heritage,have great difficulty in management,the main reason is including complex property condition,different subject to liability,the government can provide limited supervision in practice.Therefore,On the premise of without infringe private interests,how to realize the public interests as much as possible,and meet the public and the country to the basic requirement of the non-state-owned unmovable cultural relics protection,which has become a realistic problem.Therefore,with the help of public management,economics and related theory of law,this article hopes to analyze property right structure,protection practice of the management system on the change path,the features in the Game analysis of practical problems of non-state-owned unmovable cultural relics,and eventually form a relatively theoretical system of protection policy of non-state-owned unmovable cultural relics.In the aspect of the research methods,this article is based on the literature research,theoretical analysis and empirical research,the combination of generality and the individuality study methods,Through the analysis of non-state-owned unmovable cultural relics protection in China’s institutional change and game analysis of the stakeholders,to summarize the current difficulty and the reasons of non-state-owned unmovable cultural relics in our country,put forward corresponding protection countermeasures,hoping to provide policy thinking of non-state-owned unmovable cultural relics protection in the future work,to realize double destinations of cultural heritage protection and development,promote the sustainable development of China’s cultural heritage protection work.This article mainly includes:(1)Sketching the basic situation of the non-state-owned unmovable cultural relics,including the property right characteristic,distribution,type,distribution,etc.,and discusses in detail about the management laws and policies change path of non-state-owned unmovable cultural relics.Finally,analyzing the agencies,funds,measures and effects of evaluation of the non-state-owned unmovable cultural relics,to find the strategies to change the non-state-owned unmovable cultural relics’ management status;(2)Detailed introducing some famous cases in recent years of the non-state-owned unmovable cultural relics,thr-ough analyzing the ins and outs of the case to classify the management measures for non-state-owned unmovable cultural relics;(3)With the aid of game theory,roundly analyzing the deep reason of protective event of the non-state-owned unmovable cultural relics,to break the conflict superposition of non-state-owned unmovable cultural relics’ protection events;(4)Carding policy improvement experience,including domestic and international experience.On one hand,domestic experience including some successful cities in our country,which has experience in urbanization of protecting the non-state-owned unmovable cultural relics.Foreign experience including Britain,the United States,France,Japan and other countries in the protection of cultural relics related experience;(5)Facing with the reality of the dilemma of non-state-owned unmovable cultural relics protection in China,and taking example by other parts experience,we offer the policy recommendations to improve relics protection work in China from the system security strategy,finance strategy and policy implementation strategy.
