Research On Han Fei's Philosophy

Han Fei is the last thinker in Pre-Qin Period,and he is a comprehensive master of Legalist school.Han Fei is also a character that always suffered mixed praise in the history of ancient Chinese Philosophy.For many years,people’s exploration of Han Fei’s thought covers all aspects,such as political thought,law thought,rule by law thought,legal thought,ethics thought,philosophy thought and management thought and so on.On the basis of previous studies,this paper discusses Han Fei’s thought on philosophy of law.There is no doubt that Han Fei’s thought is a thought both on law and philosophy.However,its "Fa" cannot be simply equal to "law" or"rule of law",and its "philosophy" is not equal to Philosophy in metaphysics.Han Fei’s thought on philosophy of law is based on the criticism,inheritance and development of his legalist pioneers,and it is also based on the transportation of other Pre-Qin philosophers.In other words,the "law" in Han Fei’s thought is the law under the view of "philosophy",and his "philosophy" is the philosophy of"law".That is to say,Han Fei’s theory is actually the ancient Chinese jurisprudence,or it is called the "philosophy of law".This paper is divided into four chapters:The first chapter is a brief introduction to his life,study experience and diplomatic activities.Han Fei’s thought is mainly concentrated and reflected in Han Fei Zi.So the study of the book’s formation,the author,the true and false,the content of the book is also the main content of this chapter.There is no doubt that the emergence of Han Fei’s theory is closely related to the political,economic and cultural circumstances of the society at that time.It is limited to only study Han his own thought,so this chapter also expounds the background of Han Fei’s life.The second chapter mainly studies the origin of Han Fei’s theory.The thoughts of the early Legalists,especially Shang Yang,Shen Dao and Shen Buhai,had a deep influence on Han Fei,while the philosophical thoughts of Taoism,Confucianism and Mohism were also the philosophical source of Han’s theory.In this chapter,we put his Han Fei’s theory back into the history of the Pre-Qin Period and hope to grasp the source of his theory in a full range.The third chapter mainly interprets the core connotation of Han’s law,trickery,and iron hand policy.This chapter is the main part of the full paper,and is divided into two parts:First,we explore the main content of Han Fei’s law theory,trickery theory,and iron hand policy theory.Second,we explain the inextricable relations and contradictions between the three theories.The fourth chapter mainly studies the theoretical basis and characteristics of Han Fei’s thought on philosophy of law,and this chapter is divided into two parts:First,we illustrate that Han Fei’s theory is based on the theory of human nature and the theory of Tao and Li.Second,Second,we illustrate Han Fei’s theory is featured with history evolution and Militarism.
