In recent years,a large number of Qin and Han legal natures bamboo Slips have been introduced,such as the Shui Hu di Qin Bamboo Slips(睡虎地秦简),the Han Bamboo Slips of Zhang Jianshan of the Ernianlüling(二年律令)、Zouyan shu(奏谳书),the Yuelu Qin Bamboo Slips(岳麓书院藏秦简).It provides a detailed material and micro perspective for understanding the development of Qin and Han society and the ecology of political rule.It provides us with a deeper understanding of the pattern of legal administration in Qin and Han Dynasties,and brings new vitality to the study of the legal history of Qin and Han.The simple nature of judicial cases is an important part,and the application of the provisions of the law is vividly reflected,providing the most direct text for the study of the judicial system in the Qin and Han Dynasties.This article is based on Zouyan shu(奏谳书),Yuelu Qinjian(岳麓秦简(叁)),and"Liye Qinjian"(里耶秦简),"Juyan Jiujian"(居延旧简),"Juyan Xinjian"(居延新简),Dunhuang Xuanquani Han Jian(敦煌悬泉汉简),the Eastern Han Dynasty Bamboo Slips of Changsha Wuyi Square(长沙五一广场东汉简牍),and the Eastern Han Dynasty Bamboo Slips of Changsha Dongpai Building(长沙东牌楼东汉简牍),and many other materials involved in the judicial case as a research object,combined with literary,historical,simple,legal history and other related knowledge for a series Note.First,collected a total of 25 cases of Qin were recorded,and 29 cases of Han Dynasty,a total of 54 cases.according to the general nature of the case,it is divided into eight related types:death,rape,theft,bureaucratic bribery(dereliction of duty,etc.),property disputes,documents,flight,and others.The second is the sentence reading for each brief sentence of each case.And the key words of the interpretation,first to include the academic community has achieved results,and then add a revised part of the text.Finally,a shallow study on the related issues involved.
