On Legal System Of Environmental Information Disclosure

With the emergence of the environmental crisis, public'active participation in environmental protection is in increasingly need. But public's sufficient participation is on the premises of knowing about relative environmental imformation and having the right to kmow. Therefore, the Government and enterprises disclose environmental information, so as to ensure people can freely and easely get environmental information, become more and more important. For this reason, all countries in the world have steply esteblished leagal system of environmental information disclosure, in order to strengthen environmental governance, to promote the public to monitor and protect the environment.The foreign legislation on environmental information disclosure is comparatively more mature, and the have have sme common characteristics: Firstly, the subject scope is bigger, any person is entitled to apply for environmental information from the public sector. Secondly, the content of the environmental information which is to be released is more wide, including not only the information of environment elements, but also human activities impact on the environment, as well as a variety of measures. Thirdly, they have stipulated a more comprehensive relief system, which strengthened information disclosure on the environment protection area.On May 1, 2008, the Chinese"Regulations on Government information Disclosure"and"Act on Environmental Information Disclosure (in trial)"come into effect. They together establishes China's basic legal system on environmental information disclosure, definitudes the subject of environment information disclosure, the scope and approach of disclosure, as well as the lagal responsibility. The establishment of this legal system is of great significance ,for it is propitious to pomote the openness of Department of Environment Protection'work, enhanse transparency of environmental protection activity,and improve public's active participation environmental protection.However, there still exist some problems in environmental information disclosure legislation in our country. For example, the subject who is obliged to release and those who have right to get environmental information is of a narrow scope, the content of environmental information disclosure is limited, the approach and means of disclosure is not convenient enough, and the relief system is inadequacy. In this paper, the author starts form the basic concept and theory, then analyzes the main content, exsiting problems and the way to improve the problems. Together on the the analysis and practical experience in foreign legislation, the author points out some proposals on the basis of perfecting the environmental information disclosure system.
