With the distinctive advantages in droughty resistance, pest resistance, and multi-functional foods compared with the common food, genetically modified food has shown an irresistible development trend all over the world since it's emergence. Meanwhile, the safety of genetically modified food has also been called into question. It remains unpredictable about the effect of genetically modified food on human health and environment. Therefore, legal measures must be taken to prevent the possible serious consequences resulting from the safety uncertainties of GM Food. The law should be adopted to regulate the development of genetically modified food within the control of human beings, which is also the recognized measure by most countries in the world. However, the legislation of GM food safety in China comparatively lags behind, which goes against the normal development of GM food and the protection of mankind's health. Therefore, the author tries to make a tentative study of the legislation of genetically modified food safety, so as to contribute a bit effort to the improvement of legislation on GM Food safety in China.This paper gives a brief introduction to genetically modified food (hereinafter referred to as GM Food and the related food safety issues firstly. It is proposed that legal regulations are urgently needed in the development of GM Food. A comparative study on GM Food safety legislation is conducted between EU and US, from which some suggestions are raised up for reference. Then, the present situation of China's legislation of GM Food safety is thoroughly studied and analyzed. Finally, in combination with the experience of EU and US, China's legal perfection on GM Food safety legislation is discussed.In addition to the Introduction part, there are four chapters. Chapter One gives a brief introduction to GM Food, mainly its concept, classification and related food safety issues. And the necessity for the legal regulation on GM Food is elaborated in details, including human rights guarantee, ecological environmental protection and social construction. Chapter Two mainly focus on the introduction and comparative studies of GM Food legislation between EU and US. Chapter Three is dealt with the present situation of China's legislation on GM Food. And followed by a comprehensive analysis on the deficiency of China's legislation system, specific analysis concerning the supervision and legislation system is conducted, including the confirmation of rights on food safety, safety evaluation system and Right to Know protection system respectively. In Chapter Four, some suggestions from EU and US are initiated for reference,and some suggestions are put forward for the legal perfection of GM Food in China. A tentative framework on GM Food legislation system is proposed, particularly the confirmation of rights on food safety. For the perfection of supervision system, the tentative plan that endowed citizen associations with Special Inspection Rights is presented. Besides, advices concerning safety evaluation system, Right to Know protection system (Information Open System and Compulsion Labeling System) and relief system are also brought forward.
