Hospital-patient relation has become a hotspot issue in the society, and the conflict between them has become one of the factors that may affect the social stability. In the mode of hospital-patient game, patient and medical party (medical staff and institutions) are the participants;patient adopts prosecution as their assistance right while hospital participates prosecution as its action;medical behavior and error nature are information;practicing medical and juridical identifications are strategy;Indemnity to patient and compensation from hospital is payment (including prosecution fees, etc.);so the result includes: payment, strategy and balance between both parties of hospital and patient. Several problems can all be analyzed in economic methods or principles, such as which way can be chosen to cope with the relation between hospital and patient;which laws can be used to solve the medical dissentions;can the medical liability insurance mitigatethe conflicts between hospital and patient;how does the sharing of medical risks influence the behavior of both parties;how does the cost on medical dissentions influence the hospital and patient relation, etc. The economic analysis on the law that regulates the hospital and patient relation may help us understand if the law is superior or inferior, and how the law influences the strategic options for both patient and hospital.This essay utilized the Game Theory as the tool and took it into consideration that the nature of hospital-patient game aims at the reallocation of the interests, probing its reason in a way of the related behavior, and more, predicting the behavior options of both parties.
