A Study On Rational Compensation Principle About Human Tissue Or Organ Donation In China

Human organ transplantation is one of the most important medical techniques in the 21^st century. It has been the standard of the surgical treatment due to the development of the surgery, the upgrade of the storage, and the emergence of the new immunosuppressant. It also has saved thousands of patients. However, the lack of donor has been "the neck of bottle" and restricted the human organ transplantation's continual development. The cruel facts tell us that simple technique advancement cannot establish the wish of curing more people. How to increase the number of organ donor has been one of the most important issues of medical ethics.To solve the problem of donor lacking, many discussions have been operated between the law, ethics and medicine circles. The experts have proposed many solutions, but relating to the ethical disputes, technical level, they all have been pigeonholed and not been put into practice. On the base of the domestic and international experience and the situation of China, the paper made a systematic research on how to increase the organ donor. The results indicated that: some economical or social encouragement that is rational compensation will be useful to increase the number of the donors.On the base of the literature, the paper made the concept of rational compensation, its object, ways, the superiority and the differences between rational compensation organ trading and voluntary donation. It made an ethical analysis of feasibility for the rational compensation, and made a conclusion that: rational compensation is more suitable for the situation of China. It contains more consideration for the donor and their family, it also could be a kind of social safeguard, which showed the concern and support of the society to the donor. It is useful to suppress the organ trading, so it has more feasibility than the voluntary donation. Furthermore, rational compensation is consistent with the principles of altruism, beneficence, justice; it also shows the fair and unity of the society. Suitable activation will help to change the situation of donor lacking.Besides the literature research, the author designed the questionnaire which is "the public attitude toward the rational compensation in the human organ donation", and carried out a questionnaire survey. After the data was collected, the author analyzed the results with the statistics software SPSS13.0 and the conclusion of literature research was proved.Due to the constraint of conventional concept and incomplete donating system, to make the value of rational compensation come true, we should try our best to consummate the system. So firstly, we should consummate the law system of organ donation, and make a nice law environment for the rational compensation. Secondly, we should consummate the management system. It includes: establishing specialist organ donation control center; strengthening the examination of organ resource; restricting every link of donation; keeping the donation procedure developing smoothly. Thirdly, we should strengthen the education to the public. On one hand, we should think highly of the pervasion for medicine knowledge; on the other hand, strengthen the education of ethical information.
