A Comparative Analysis Of The Management Laws And Regulations Of Cross-strait Traditional Chinese Medicine Physicians

With the gradual deepening of exchanges across the Taiwan Strait, the communication levelcovers almost all fields,among which the exchange of Traditional Chinese Medicine is one of themain ones.When any exchange has reached a certain stage of development, it demandscommunications of regulations and policies. The exchange of TCM across the Taiwan Strait is noexception. In recent years, as it becomes increasingly intense, its content deepens. And themanagement laws and regulations of TCM physicians across the Taiwan Strait increases,to whichcross-strait scholars and departments it conerns pay great attention.Because of a variety ofdifferences in the management of cross-strait TCM physicians, the deepening of the communicationof TCM across the strait needs a comparative analysis of the management laws and regulationsinvolving guidance policies, management measures and laws & regulations,etc.Therefore we canbenefit from it and it will shed light on the drawing of policies and measures. The thesis aims toprovide reference for the related departments to make management policies for TCM physicians, andfor the researchers to carry out studies; to promote the communication of management laws andregulations of cross-strait TCM physicians; to contribute to the peaceful union across the strait. Inorder to achieve the above goals, the author carries out a study on the management laws andregulations of cross-strait TCM physicians, makes a contrast of cross-strait TCM management andnotions of legislation and reveals the importance of TCM management in the cross-strait TCMcommunication.The thesis takes the literature of the revlevant management regulations of TCM physicians as the research object to conduct the in-depth comparative analysis from the perspective of law and medicine.On the basis of investigation and study,the author summarizes the difference and similarities, history background and illuminations of the formulation of management laws and regulations of cross-strait TCM physicians. The thesis begins with a brief introduction to the history origin and legislation background of the management of cross-strait TCM physicians.This introduction shows the possibility and necessity of the comparative analysis of the management laws and regulations of cross-strait TCM physicians.Then the author divides the management policies of TCM physicians into qualification management, business management,rights and obligations, legal responsibilities and penalties in order to find out the differences and similarities in this respect across the strait,to make a systematical introduction to the different aspects of the management of cross-strait TCM physicians, to explore the reasons for differences and legislation notions.Though the research the author draws the following conclusions: First the legislation notion in mainland is to maintain TCM, to preserve and carry forward the characteristics and to develop TCM. Therefore the heritage protection and the regulations of the management of TCM therapy are more reasonable,while Taiwan pays not enough attention to the heritage protection of TCM and the relevant provisions are not full.Second,the operational measures of laws and policies in mainland are not so complete, while Taiwan does well in the accuracy and operation aspects of specific policies,which is available for reference.Finally, the degree of specialization of legislation is higher in Taiwan than that in mainland.
