With the development of the economic integration all over the world, the liberalization of trade in service has developed in-depth. Every country has paid much attention to it. Healthcare is related to everyone closely, and every country pay much attention to the protection of public health. Recently,each country has emphasis on the protection of the rights with their own citizens.The European Union (EU)is unique organization with the highest level of integration and welfare in the global, the experiences in the field of healthcare from European Union is also worth to learn for us.Usually, the patients within EU prefer to seek healthcare in their own country. But in some circumstance, because of the movement of the patients, or the healthcare with highly specialized treatment,or in the remote areas. The patients need to seek the healthcare in the other Member State. However, due to the different national systems in the source of healthcare, the legislation and the structure in the Member States, the patients'rights was hard to been protected. In recent years, the cases about the protection of patient'rights in cross-border healthcare to the Court of Justice has become more and more, the European Commission has established the Directive on the application of patients'rights in cross-border healthcare.Therefore, this article is on the basis of existing research, and in the background of the integration with EU, explore the prior authorisation of cross-border healthcare; the patients'right of the reimbursement;mutual recognization of professional qualification and so on. Making a study on this Directive.We could learn the experiences in the field of healthcare on how to protect the patients'rights in EU according to this directive. With the status quo about China in healthcare, establish the legal systems on the cross-border healthcare or cross-provinces healthcare to protect the fundamental rights with patients. Eventually, come up with some strategies and suggestions.
