Object:Because the phenomenon of practicing medicine illegally has existed for a long time and it is hard to be forbidden, by analyzing practicing medicine illegally with or without a license, according to Shanxi's efforts to deal with this phenomenon, according to current law, regulation and the theory of optimize the allocation of health resources, we did a research on the characteristic of the phenomenon and the problems occurred while the Shanxi health supervision department coping with the phenomenon. We want to bring up some relevant advice on how to deal with the phenomenon in order to provide a basis for Shanxi health supervision department to deal with the problem scientifically.Method:1. Statistical survey:We mainly use the statistic forms from office of national crack down on the illegal practice medicine, together with the results of routine patrol and special inspection by health inspection personals. We collected and analyzed the whole information of cracking down on the phenomenon of practicing medicine illegally and relevant information from health inspection department of Shanxi province from 2007-2009.2. Document retrieval:Searching relevant medical document from official periodicals, books, Internet and medical database, etc., to obtain information about the phenomenon of practicing medicine illegally.3. Interviewing experts:Talking with relevant experts from Shanxi health inspection department, discussing the current situation of the phenomenon of practicing medicine illegally and effective countermeasures, understand their knowledge and comments about it in order to provide information for research.Conclusion:1. From 2007—2009, the phenomenon still prevail existed in Shanxi province. The phenomenon of practicing medicine illegally in city communities has been curbed effectively, however, in rural area, this phenomenon is still not under effective supervision, and cases were increasing; the phenomenon was still very serious, especially in basic-level, the illegal cases were increasing.2. Due to the uneven distribution of health care resources, especially the uneven distribution of good quality health care resources, there is a huge market of illegal medicine in low-level population, especially in rural area. The illegal medical stuff can escape the law easily, the ordinary people are not fully aware of it, basic supervision departments are not completed, their supervision is not strict enough. All these factors lead to the phenomenon hard to be banned.3. The phenomenon is still very serious in medical institutions. Due to loose supervision, inadequate training and not enough awareness of law, the illegal cases in basic-level medical facilities were increasing, of which employing medical personal in an illegal way; treating patients beyond their capacity are very common.4. currently, because the financial support to health supervision is inadequate, we are in shortage of health supervision personal and equipment, the check on basic-level medical institutions is not enough, the law and regulation is lag-behind, the punishment is not server enough, the coordination between each enforcement department is not completed, the administrative enforcement and transfer are not smooth.Countermeasures:1. Deepen the reform of medical and health systemAccording to the requirement of maintain the foundation, strength the basic-level, build the system in the 12th five plan, the government of all levels must increase the financial support, deepen the reform of medical and health system, complete medical care insurance system, keep on building up new rural cooperative medical system, enhance the coverage of health care insurance, eradiate the market of practicing medicine illegally.2. Optimize the allocation of health care resource; Increase the support to health care supervision.Reset the unreasonable resources in a scientific way; Merge the medical institutions that have the same functions or single function. By sharing resources, we can enhance the overall level, lead to massive profit. We should increase the support to health care cause; increase the access to health care serve to cover every part in our province with basic health care serve. We should increase the support to health supervision hardware and software in order to build health supervision team with high political quality, professional quality and law quality.3. Increase propaganda and educationGovernment departments of all levels should increase the propaganda by all means, let people really know the practice medicine illegally and its danger. The propaganda should focus mainly on ordinary people and the people who practice illegally. We should pay more attention to its real effect by following them up and interviewing them; we should raise the awareness of law among those who practice medicine illegally and the awareness of self-protection. We should build up reward system for those who report the illegal action. We should win the support of the society to boycott and crack down on the illegal action.4. Complete the law and regulationsWe suggest that we should complete the details of law and regulations, focus on increasing the fine on practicing medicine illegally. The relevant law should be explained so that the enforcement can be carried out effectively, hoping that the health law, regulation, criminal law and other relevant law can be well combined together.5. First, party committee and government of all levels should establish a special united organization and a special fund to increase the support in forms of personal, fund and equipment, which can combine all departments together. Second, we should establish a combined enforcement mechanism between every enforcement department which can form a situation that led by the government, supervised by each department, the whole society join in. Third, we should establish a case transfer mechanism which can combine health care department, industrial and commercial department, medicine administration department and public security department together, realizing a mutual transfer mechanism. Finally, establish an evaluation system on cracking down practice medicine illegally to check the real effect of government of all levels and departments.
