The town and township enterprises, with the Chinese characteristics, are a great pioneering work by the Chinese peasants under the circumstances the market economy is developing. With the purpose of promoting the town and township enterprises to grow steadily to play a better role in the national economy, Chinese government issued and implemented the Statute on the Town and Township Enterprises of the People's Republic of China on January 1st, 1997 after 10 years' full preparation. First of all, this statute has definited the basic guiding policies, the important principles and the main tasks on the town and township enterprises development. Furthermore, it has established the town and township enterprises' property rights, specified their obligation to support the rural economy, proposed the preferential measures for their development and also standarded their behavior. Therefore, it is the legislation with Chinese characteristics.However, many problems and defects have exposed after 4 years' practice. The obvious problems are the following: the too theoretic preferential measures, the lack ness of the corresponding laws and regulations, the weak binding force, no guarantee of the town and township enterprises' rights and interests, difficulty of behavior standardization, implicity of the executive body, ambiguity of the legal responsibility, difficulty of the executive means and so on. In the several years, the period during which the Statute on the Town and Township Enterprises has been putting into effect is just the moment that our economy system and economy environment have taken rapid changes, the successive and unprecedented problems are emerged at this turning time in the courses of transition of system innovation and structure adjustment, hi view of this situation, it is vital to complete the legal system and enhance the executive power for the defense of the sanctity and authority of the law and for the development of the town and township enterprises.This thesis starts with analysis Chinese town and township enterprises' special developing history and then- important status. Then it discusses the significance to establish the town and township enterprises legislation and to strengthen the legal system. It points out the chief problems too. Finally it offers some good proposals on completing and strengthening the law strictly.
