The transformation of government function is the key to the so-called "essential" institutional innovation. The governments of the villages and towns in the transitional period still function as the omnipotent people's commune under the planned economy. Such malpractice as the confound functions of the government and the society, the government and The Third Part or NGO and the government and enterprises seriously hinders the opening up of rural market and the reform in the governmental administration arising there from. We must transform the functions and make the transformation the focal point of the new round of institutional innovation for the villages and towns. The breakthrough point in the transformation lies in the blazing new trails in the policy-making system of the villages of towns - to separate politics from the party so as to improve or rather to restore the supreme status of the people's congress of the villages and towns in the decision-making system on legal principle. To transform the government function successfully, clear line must be drawn between the government and the society, the government and The Third Part or NGO and the government and enterprises. The process of the opening up of the rural market and the reform in the government administration demands that the government functions of the villages and towns should be restricted to cultivating and standardizing the rural market, seeking social justice, stabilizing and fostering civil society and so on.The transformation of the government function of the villages and towns will inevitably leads to the institutional innovation and the repositioning of the redundant personnel. The adversity of the macro economic circumstance, the serious excess of personnel and the psychological factor of those who would be repositioned all make it more difficult to reposition the redundant personnel. To solve this problem, we should encourage the development of rural market economy, expand the channels to deposition the redundant personnel, take the advantages of the unique educative role of the ideological and political work and standardize the system of civil servant which is characterized by fairness, openness and going on duty through competition.Institutional innovation for villages and towns should also be guaranteed by administering (establishing manning quotas) according to law and the reform of taxation and fees. Then the institutional innovation can be truly realized and the reposition of the redundant personnel can come off as scheduled.Finally, from the point of view of State-Building, the emergence of the villages and towns as State-Brokerage again calls for institutional innovation of the villages and towns and echoes what mentioned above. It also defines and stipulates the double goals of promoting the rural market economy and pushing forward the reform in the governance of administration of the villages and towns.Two plans of institutional innovation for villages and towns are attached at the end of this paper.
