It is the most important characteristic that the administrative body has privileges in administrative contract. Privileges of administrative body play significant roles in the establishment, utilization and relief of administrative contract. In order to give full play to its superior function and active role, administrative contract must be normalized; privileges system of administrative body, which is an essential composition of administrative contract, should also be established and perfected.The contradictory of public interests and impediment of public interests provides proper space for the existence of privileges in administrative contract. In order to guarantee the realization of public interests and management object of administrative contract, the administrative body must be bestowed the privileges. At present, many countries affirmed the necessity of privileges in administrative contract, but their models of disposal are different, which is influenced by their law tradition, culture, background and national characteristic.At present, the research of the field in privileges of administrative body in administrative contract isn't optimistic in china. Many problems still exist. So the privileges system in this aspect should be systematically constructed. The relief of administrative contract is a protruding problem in the whole system of administrative contract. From the angle of privileges of administrative body in administrative contract, bringing the administrative litigation is a possible solution to the problem of the relief of administrative contract.The author discussed the privileges of administrative body in administrative contract from many aspects, by comparison and pragmatic research.
