China is largely based on agriculture, so agricultural trade is important parts on our foreign trade and it's played a significant role on earning foreign exchange and advancing agricultural modernization. After being one member of WTO, due to comparatively laggard infrastructure, low-tech products and lacking of world competition on the agricultural field, we would take more severe competitive impression with increasingly open and free world market. As a result, it would be popular that more and more agricultural disputes among members of WTO would happen and be settled by WTO dispute settlement body. On the one hand, we should be good at utilizing advantageous regulation of WTO and dealing with disputes by actively exerting dispute settlement system. On the other hand, it'd be more possible that China would be appealed to DSB by other members of WTO. Therefore, we should take an in-depth study on WTO dispute settlement system and effectively take use of it, research into relative WTO agricultural disputes, and so on. All these measures would speed up our development on the agricultural field and safeguard our country and farmers' benefits. From this purpose, on the basis of all the preceding research work, the author uses the method, which combines the theoretic analysis with the cases analysis, to analyze and research agricultural dispute settlement system and practice for achieving meaningful revelations in order to help deal with agricultural dispute with other members of WTO. First of all, the paper emphasizes the system of law on settling agricultural disputes. Through analyzing this system's advancement from the period of GATT to the period of WTO, applying law and economics analysis to measure economic cost and economic benefit of WTO dispute settlement system in order to obtain some suggests for pursuing most economical way to deal with our agricultural disputes. Secondly, through collecting and classifying all agricultural dispute cases from starting of WTO and having an in-depth discussion on one classical case, the paper points out a series of disciplinarian and characteristic in order to achieve feasible ideas for help our country avoid disputes and effectively apply this system. Finally, on the basis of analysis of dispute settlement system and practice, the paper bring forward some meaningful revelations with present situation of agricultural trade in China from being member of WTO. In a word, with entry into WTO, China would be accuser and defendant in more and more agricultural dispute cases. Therefore, we should get to know this system continuously and track and collect cases in good time so that we could strengthen our ability to settle agricultural disputes by combining obscure and elusive regulation of WTO with vivid cases in practice.
