Research On Primary Problems Of The Legal Regulation Of Trade Association In Our Country

The rise and development of social media organization in the last century was one of the greatest achievements of the development of civil society. In China, with the deep going of the reform in the politics and economy, as the important part of the social media organization, the trade association also gets a good chance of development. And is being paid much attention. Many researchers do a lot of research work in the development of trade association in the region of economics, sociology and public administration. Although, many sector of the trade association is also relation with law from its establishment to running. The research work of law science in the region is far to the needs. This article makes researches on many problems of the law 's regulation of the trade association from the standpoint of the law science.The research in this paper is based on the theory of civil society, and the condition of the trade association in China. The paper analyses the key problem of the legal regulation of trade association. Including its base of theory of law science,realistically needs,actual state,pattern of regulation and content of regulation. The paper believes on the one hand trade association is a fundamental power of civil society; on the other hand, trade association has its inviolable weakness. In China, in the surroundings of domestic reform and competition of international trade, the legal regulation of trade association is an inexorable trend. The last two chapters is the gist of the paper. In chapter â…£,it examines the pattern of legal regulation of trade association, and choose the pattern of cooperation with total and special regulation. The chapter â…¤is divided into two parts, it examines the legal nature of trade association, elaborate the legal right of the trade association, including the right of rules making,supervision power,nonlegal penalty right and dispute dissolving right. These rights are absolute necessary to the development of trade association. In the final, the paper examines the limit of the right, `especially the antitrust limit.
