The Legal System Investgation Of Our Country' Social Pension Insurance In The Countryside

One young country is growing older and older and China is the first developing giant which will step in to the stage of "aging society" and the percentage of the people who are over 65 years old is more than 7%of the whole population. By the end of 2008 this proportion had reached 8.3%with 109.56 million people and among these people the elderly people in the rural areas counted for 65%, namely the elderly people in the rural areas is 1.7 times'of that in the cities. However China is now stepping towards the aging society under the condition of under-development of the economy and the situation of "aging but not affluent", is facing us. How to resist the "grey hair waves" flooding in the rural areas is the puzzle encountered by Chinese government. In combination of the existing situations of pension issues in the rural areas and the successful experiences concerning pension in the rural areas in the developed countries one set of scientific and perfect rural pension insurance system should be set up. In the year of 2009 China had started new type pension insurance pilot works, which was imperfect in terms of piloting and which needed to be finalized to form ideal pension insurance system based on the experiences of pilots. The effective implementation of one set of system and policy necessitates the vitality, formality and persistence endowed.by the legal system. The construction of the legal system of pension insurance in the rural areas in China lags far behind form the point of the level of legal construction and frankly speaking China has not set up one set of ideal legal system of the pension insurance for the rural areas. The assumption to construct Chinese rural pension insurance legal system in combination of Chinese national conditions is put forward and to perfect the pension insurance system of Chinese rural areas through legal system is one important approach.
