On The Legal Variation In Shanghai French Concession During The 1941-1943

December 8, 1941, Pacific War broke out. Because of Japanese Army's invasion, Shanghai French Concession had a legal variation. In this regard, this thesis will concentrate on the changes under the indirect control of Japanese army in terms of the legal situation in the French Concession after the Pacific War, its features, its impacts as well as the role the Shanghai Administration Municipale played during the 1941-1943. These are questions the author trying to answer in this thesis.The following three parts formed this article: the Introduction, the Main Body that is composed of three chapters and the Conclusion.In the Introduction, the Author will first give a definition on the time of the last three years, making clear the time zone of this research. Then, it will start from the purpose of the topic and elaborate the research value and meaning of this dissertation. Next, the Author will provide a brief introduction of the related academic and study situation, as well as the historical sources used in this article.The Chapter One of the Main Body will mainly introduce the variation of the legal institutions in Shanghai International Settlement during the 1941-1943. The Author will begin from the legislative institutions, police institution and the judicial institutions, focusing on the transfer of personnel of the above institutions in the 1941-1943. A conclusion then could be come out that the changes are the result of the power contesting.The Chapter Two related to the variation of the legal content in French Concession. The Japanese imperialism exercised the fascist colonial domination in the occupied areas in order to meet the needs of the invading war, which made the legal content with obvious colonial features. Based on historical data, the author reorganize the legislations and statutes of the French Concession in 1941-1943, and sum up two types, the new regulations of Administration Municipale and the announcements of Japanese Headquarters, to give a detailed introduction of the wartime colonial law in 1941-1943.The Chapter Three is the theory distillation of the above Chapters. By comparison, in summary and analysis, the author will generalize the features and impacts of the legal variation in Shanghai French Concession during the 1941-1943. And hence come out the final conclusion.
