Social Transformation Of Rural People's Mediation Mechanism

China is a large agricultural country. The rural issue is a focus in Chinese politics and economic development. Concern of contemporary China must pay attention to the countryside. Attention to rural issues is inevitable to involve the solution of rural community dispute. Contemporary rural society is undergoing the hardships and collision of transition, full of contradiction of tradition and modern, the intersection of old and new contradiction, the complicated and multiple disputes, dispute resolution need to be adjusted. At present, the discussion of domestic scholar to the he rural area dispute and the solution mechanism is not sufficient, most of them discuss it from the perspective of anthropology and sociology, seldom discussing from a legal point of view. Therefore the author chooses the people's mediation mechanism in rural dispute,attempts to analyse the advantages and disadvantages of the present people's mediation mechanism from the perspective of the Civil Procedure Law, and how to improve the rural community to fit for change and development.The thesis mainly concludes four parts. For the first part, it described that at present the countryside is in a transition period, which is characterized by multiple dissension and complicate legal relation. The family dissension accounts for the main part, but countryside society is still an acquaintance society, which makes the people mediation is an effective and important method to solve the countryside dissention. Part 2Investigate and analyze the current situation of rural people's mediation to find out the deficiencies on mediation funds, mediators, procedures, implementation and other aspects in the rural mediation practice, and to explore the cause of deficiencies. Part 3. Put forward a rural people's mediation improvement basis to meet the actual needs of mediating rural disputes, building a diverse rural disputes mediation system, and modernizing the legal system in rural areas.Part4, Propose the importance of consummating the mediation system of country and make some direct suggestion according to the actual status of country society. The mediation system is a traditional way of solving dissensions, but it is also important to constructing a legal, modern country according with the society status. It is also important for our multiple dissensions solving system. There are many ways to make mediation system work well, such as: building better mediation environment, consummating mediation legal, enhancing relative operators'abilities and joining mediation and litigation systems together.
