The teacher appointment system in universities is one of important part of in a personnel system. There are still lots of controversies in theory and practice and some problems also exist which result in little progress found in Teacher appointment system in universities. Among many reasons, the common sense has not been reached in some legal issues in Teacher appointment system in universities and some of them is still in hot debates. This essay mainly focuses on legal status of universities teacher's legal status, rights and obligations in universities and legal areas of employment contract and some policies related to effective implementation of employment contract in universities.The legal status in universities is unclear in current legal system. According to The general rule of the civil law, the universities should be defined as Legal institutions. While some people argue that the universities is a organization granted by law which has administrative qulification. As a institutions of higher education granted by government, the universities must accept the government's administration and obey the government's order.Teacher in Teacher Law is defined as the professionals who carry on educational duties, educate students, develop socialist builders and successors and prompt the national quality. In our country, the teacher's legal status in universities can be analysed in two aspects. On one hand, from point of view of relations between educational administrative agency and legal agency, they are subject of administrative and administrative counterpart respectively. On the other hand, from point of view of relations between teacher and legal institution, they are expression of common will and the dominant position of equality.For the key area of employment contract in teacher appointment system, our legal system don't give a clarified definition. It just formulates principles and ways in implementaion of teacher appointment system in universities. That is both should be on an equal footing signing an employment contract between president and employed teachers.The legal remedies of rights in the process of teacher appointment in universities can also make sure the realization of basic teacher's rights. This essay studys teacher's rights under appointment system. And it places an emphasize on analying the current problems under appointment system, explores the reason leading to these problems and poses some supporting policies to solve these issues.
