Researching Into The Problem Of Interests

The problem of interests is a philosophical problem, but also a practical problem. Marx once said that all the things that people are fighting for are related with their own interests. No doubt, each person just considers his own benefit when he does something. Therefore, it can completely understand the whole human society and find the inner motivation of social and historical vicissitudes to stand on the high level of interests. Great revolutionary teacher Lenin clearly indicated that the problem of material interests is the basis of the whole world view of Marxism and asked us to remember it every minute. Nowadays, China which has opened and reformed more than 30 years has already begun to build a harmonious society, so we have paid more attention to the Marxism interests.It pointed out that the pattern of social interests China has changed in the new period at the Party's Seventeenth Congress. There are many arguments about interests in the congress, such as "people who create interests share them", "the basic method of Scientific Outlook on Development is making overall planning and all-round consideration, including the overall consideration of the interests" "the power entrusted by people must be ensured to use for people's interests" etc. From this, it can be seen that the problem of interests has become the focus. We must look into it in order to construct the harmonious society.In the 21st century, information era, the computer network develops rapidly. It has changed the relationship of human communication and brought a completely new communication mode, even promoted the rapid development of the knowledge economy. However, at the same time, the networks also bring more and more negative effects, especially in the distribution of interests. In this respect, problems of network copyright are representative. In recent years, the problems of network copyright have become more and more serious, which shows the change of network interests well. It can research the problem of interests thoroughly to combine network copyright protection, because it can keeps us stay on top of interest conflicts.Now, although there are some scholars who research the problem of interests and academic works about it, most of them are for Chinese and western views of interests comparative study, or study Marxism interests from Marx's classic works. Few scholars study this problem from the angle of network era, if any, also from the aspect of law, not Marxism philosophy. But in fact, it can explore Marxist interests more thoroughly to combine the network copyright protection from the perspective of Marxist philosophy. I just want to have some new exploration in this area.This thesis firstly analyses the interests problem of network copyright, then illustrates the interest noumenon and operation problems in Marxist philosophy range, finally make the new exploration of interests under the network environment, especially from two aspects, principles and specific operational issues of network copyright protection under the direction of Marxist interest. The above statement is the main problem and view of this thesis which consists of foreword, the first part, the second part, the third part and the forth part and conclusion.The foreword explains that the network copyright problem stands for the change of network benefit pattern best, from the angles of the backgrounds of ear and society, combining practical situation. Therefore, it shows the thesis's meaning.Part one firstly traces the origin of the network copyright disputes, then analyses the characteristics of network copyright cases starting with the characteristics of network copyights, in order to divides three periods of the network copyright disputes. At last, it discusses the complex relations of interests existing in network copyright.Part two follows the guidance of Marxism philosophy. It draws the essence of Chinese and western philosophy. It explores the interests' connotation, classification, the relationship between some kinds of interests' classification and the relationship between law and interests by criticizing the mistakes of interests in Chinese philosophy and western philosophy.Part three firstly analyzes how to set interests in Chinese and western philosophy, then puts forward the setting of interests in Marxism philosophy. Neither like personal interest is completely negative in Chinese philosophy, nor like social interest is depreciated in western philosophy, Marxism philosophy advocates case by case. On that basis, it discusses how the interests operate and how the law adjusts the interests.Part four firstly starts from the virtual network. It analyses the influence of network on interests from two aspects, virtual practice and the paradigm of network copyright. It confirms that although the network is virtual, people's practice which occurred in network is true. It also absorbs two kinds of views about the paradigm of network copyright dialectically. At the last, it gives advice to interest balance from two aspects, principle theory and practical operation.The conclusion summarizes the content of the thesis and confirms that Marxism interest is an important leading thought for building a harmonious society in network era. It puts forward that the domestic interests must be reasonably distributed by a perfect legal system and the international interests must be balanced by an effective communication mechanism.
