The Problems And Countermeasures Of The Present Supervision System Of Administrative Power Of Our Country

Executive power is the state's right of monitoring public administration and social issues, and an important component of the modern power structure system. The supervision of administrative power on the law is necessary to the people's sovereignty and improving administration, building the necessary civil service. This is an important part of the administrative system reform and innovation. Administrative supervision and administration plays an important role in the country's political life. Various elements of the supervision of administrative power form the supervision system of the executive power. The existence of a sound monitoring system is to protect the right of government decision-making, proper implementation and maintain integrity. We must strengthen the supervision of administrative power, so as to guarantee efficient operation of administrative power.At present, China's monitoring system still has some shortcomings, the overall function of administrative supervision system is not strong, self-supervision of party and government power is strong, but external supervision of the party and government power is weak. Supervision of the ruling party of the state power is strong, but weak supervision inside and outside. Strong oversight powers, separation of powers weak and strong supervision of the specialized agencies, weak supervision by the NPC, monitoring on the lower level is strong, but weak at the same level. In the existing power monitoring system, the external constraints of the local party and government leaders are weak. Legal binding power is more effective than the power of discipline, but discipline of officials is much stronger for our party and government. Their own moral self-cultivation and self-discipline plays a key role. It is the blind spot to monitor the most powerful and most in need of supervision and the mistakes of decision making at all levels of party and government .Since the reform and opening up ,the party and government's awareness of the role that technology measures plays in the monitoring system is not yet enough, and network technology and other means have not been used in the running of public power and the supervision work. State legislature has not been yet implemented in the ruling party's supervision. Therefore, further improvement of our executive power monitoring system is necessary.China's current level of democracy and the rule of law doesn't achieve a high level ,concentration of power and party leadership structure has not been fundamentally changed, and the main party and government leaders at all levels is difficult to be effectively monitored, laws and regulations, judicial review or constitutional review system does not yet exist.The existing monitoring system enables the main object to subordinate supervision, lack of independence and authority, and therefore on the same level party and government leadership oversight, not oversight, supervision issues inconvenience. External oversight of the ruling party is not enough. Some aspects of political reform lagged impact on the effectiveness of supervision system. "Parliament and the executive" power allocation decision-making, implementation, monitoring both the relative lack of separation of the right to restrict the checks and balances one another. Media Supervision is lack of effective legal protection.
