The Study Of Good Faith In Acquisition Of Immovable Property By Good Faith

Our Property Law has established the system of Acquisition by good faith. But the constitutive requirements of the system aren't so clear that we should explain them concretely. One of the most important constitutive requirements is the good faith. In this thesis, I will analyze how to judge the establishment of the good faith.The first chapter is to discuss the basic theory of the good faith. The first chapter firstly reviews the history of the Acquisition by good faith. Then I discourse the connotation of the good faith. Finally, I analyze the good faith in the Acquisition by good faith.The second chapter is the judgment of the good faith in the Acquisition of immovable property by good faith. Firstly, I discourse the value of good faith as one of the constitutive requirements of the Acquisition by good faith. Secondly, I concretely analyze how to judge the establishment of the good faith.The third chapter is comparison between the good faith in Acquisition of immovable property by good faith and Acquisition of movable property by good faith. Firstly, I summarize the similarity. Then I generalize the differentia. Finally, I analyze the reason which causes the differentia.This is the structure of the thesis. The first chapter is the foundation of the second and third chapter.
