Resale Price Restraint in the field of anti-monopoly research, which is also named as Resale Price Maintenance (RPM), refers to the fact that the product manufacturers or suppliers demands that purchasers must resell their products according to a specific price level. Resale Price Restraint, conducted by business dealers in marketing competition, is a type of illegal act, restricting competition seriously. This action not only leads to the loss of profits both for business dealers and social welfare, but also severely breaks the regular rules for marketing economic freedom and justice.About the anti-monopoly legal regulation towards resale price restraint act, developed countries and entities, such as America and EU, have experienced intensive theoretical research and long-term development of legislation and justice practice. Up to date, some efficient regulation modes have been formed, such as the American "Per se Rule and Reasonable Rule" mode and the EU "the principal of immunity against+ exception" mode. Abundant experience of legislation and justice has been accumulated, which has a high value for reference to our country in the field of legislation and justice. Compared to developed countries, the relative research in this mentioned field in our country's current law circle is still insufficient. The legislation and justice practice are also in the initial period. The paragraph 14,15,46 and 50 in our country's 'Antimonopoly Act' make specific regulating rules on the resale price restraint act, but the abstract and summary-like rules have placed the relative regulation into dilemma. Therefore, based on advanced experience from other countries, it is essential to improve our country's 'Antimonopoly Act' and regulate effectively on the resale price restraint, thus to establish ordered competition environment and stimulate steady economy development.
