The name of the Republic of China on Road Traffic Safety Law (hereinafter referred to as the "Road Traffic Safety Law") for the first time clearly defined areas in the motor vehicle insurance compulsory insurance on 1st 2004. The Compulsory Automobile Liability Insurance(hereinafter referred to as "Regulations") further specified the vehicle to pay compulsory insurance systemonJuly 1st 2006. China has formed a relatively complete compulsory traffic accident liability insurance (hereinafter referred to as "motor vehicle traffic compulsory insurance") legal system.Because motor vehicle traffic compulsory insurance system in China's implementation of the relatively late time, leading to lack of practical experience; both experts and scholars of the theory is not long.China's motor vehicle traffic compulsory insurance system currently still some legal issues.These problems are mainly business model is not clear, insufficient protection of the rights of victims, the general phenomenon of excessive medical care, lack of social assistance funds.In this paper, strong narrow vehicle combing the historical development of the system based on compulsory insurance of motor vehicles to pay the meaning and characteristics of the basic issues and areas of foreign insurance vehicle developed and Traffic Insurance System and practice of the system.Finally, points out the problem of motor vehicle traffic compulsory insurance system is proposed based on the author's views and put forward a sound proposal.In addition to the introduction and the conclusion part of this paper there are four large part outside.The first section describes the motor vehicle insurance to pay the general theory of strength, its emergence and development, meaning, characteristics made a more comprehensive exposition to the reader less familiar with the basic characteristics of this system.The second part from our national conditions, describes the strong cross-country motor vehicle insurance claims related to legislation and practice in some of the issues.The third part of the major developed countries and the relevant system areas of a large number of rules of presentation and the author sums up this useful little enlightenment to China.The fourth part, through the foregoing analysis, put forward a number of existing sound advice.
