The Research Of Travel Agencies' Liabilities In Travel Contract

According to the travel contract, travel agencies should provide tourists with such services as accommodations, caterings, entertainments and transportations, etc. In performing travel contract, there would be damages of tourists'interests directly caused by travel agencies, as well as those by the third-party which provides such services as accommodations, caterings, entertainments and transportations. In judicial practices, there haven't been specific legislations on travel contracts in China, resulting in the lack of explicit legal basis in dealing with travel disputes and ultimately the inefficiency in protecting tourists'rights. In consideration of the above-mentioned conditions, this thesis will make a research on travel agencies'liabilities from the following three chapters.Chapter 1 An Overview of Travel agencies'liabilities in Travel ContractAnalyzing the characteristics of travel contract and travel agencies' liabilities based on the connotation of travel contract.Chapter 2 Travel Agencies'Liabilities and imputation principle in Travel ContractSpecifically elaborating liabilities for breach of contract by the travel agencies as well as those by the auxiliary servers with reference to problems in judicial practices and overseas legal provisions.
