Research On Enforcement System Of Agreement On Trade-Related Aspects Of Intellectual Property Rights

Agreement on Trade-Related Aspects of Intellectual Property Rights is an international agreement which is of wide aspects ,high protection level ,powerful protection strength and strong enforcement on the worlds scale at present .Therefore ,it is attached much importance to by all countries and independent customs areas.The agreement on TRIPS marks a new level of the world's protecting of the intellectual property rights.Our country has already entered the WTO , it means observing every obligation stipulated in TRIPS agreement, namely, the fundamental principle and the minimum standard of protecting the intellectual property rights for the numbers of the WTO. Presently,the administration of justice of China's intellectual property right protected has already realized the butt joint on the whole with TRIPS agreement through the revision of the relevant intellectual property right law , and also has Revised and perfected the regulation in the law before, which contravening this agreement. This thesis makes a comprehensive comparison between enforcement system of administration of justice of our country and TRIPS. Besides, this thesis notices the difference between the developed country and developing country on the intellectual property protection level too, and the characteristic which the developed country intends to utilize TRIPS agreement to control the developing country's economic development technically, So China should not adopt the suitable principle directly to use TRIPS agreement in the judicial practice of the intellectual property right.
