Study On Legal Problems Of The Conflict Settlement System Of WTO

WTO conflict settlement system is just a little part of the vast covenants and papers of WTO .The aim of the system is to provide a way to midiat trade disputes between party countries.As the world is becoming mulipolar and economy global,the system has been getting more and more mature with the great efforts all the parties have made.in this article,I tyr to analyse the system on backgroud,character,origin and developing trend through deeply studying in order to accelerate the system's reform,make our related law and policies being in keeping with the WTO rules,provide reference for the reform of the domestic lawsuit systems.In the studying of the litigation characteristics,I found that there are peculiarities in legal nature,lawsuit subject,established foundation,organization,construction and power of force.However, they drew many rules from lawsuit system.they have a trend to mix together.I draw a conclusion from the studying: WTO conflict settlement system is an international law procedure standard which the party counties use to settle the trade disputes and must be abided by. It depends on the conscientiously observation of the parties. It includes such measures as diplomatic (consulting, midiation),arbitrating(alternative arbitration procedure), judical(present to expert group to arbitrat,authorized retaliatory measure).It is a synthetical standard on dispute settlement mixing with diplomatic,arbitrating and judical measures.it is becaming a powerful enforce juridical system step by step which is in keeping with the developing direction of WTO rules.
