Rural Society And National Law Study On The Situation Of Rule Of Law In Rural Society Of China

Rural society has always been treated as a symbol of traditionalism and laggards, which has frustrated normal authority. Especially when the course of rule of law isn't rough like before, the conflict between rural society and national law has become more and more obvious and unneglectable. As a factualist, the author prefers to search after some new mode of reasoning to analyze the thinking and behavior of the two parties, as they encounter with each other. In a word, the article insists that the conflict between rural society and national law is not absolute, and those negative factors unbearable for state also can be changed and even used in certain condition. Anyway, to promote the benign development of the two parties, the government should carry more responsibility and play a more active role, which makes some reform on law and politics necessary and urgent. The preface introduced the background of social reality and present research involved with the topic, then the author clarified some important categories appeared in the following parts, and finally the preface explained the logic through the whole thesis. The first part of the article is the analyses to the performance of rural society in the position for state. This part reviewed the intention and aims of rule of law, then construed the role of rural society in the course, in the end, the author particularized the reason of the conflict between the two parties. The second part of the article is the analyses to the performance of state in the position for rural society. This part discussed the situation of autonomy of rural society, and find out the key knot connect the two parties. Then the article illustrated the understanding and attitude of national law of the members of the rural party, and finally the author dissertated the process of rule of law with a dynamic visual angle. The third part of the article put forward with some suggestions towards the reform on law and politics in order to promote the relationship between state and rural society. Of course, the view is on the base of parts above. The last part of the article summarized the thesis.
