Study On Judges Selection In Our Country

System of selection of judges is the regulation of acts to stipulate the qualification for judges and selection of judges system. It is the important content of the construction of professionalism of judges, which is regarded as the "throat"of professionalism of judges. Its purpose is to guarantee the selection of legal elites in system, to improve the quality of judges, and accordingly for handling with the "explosion of litigations"and gradually novel and complex cases, for prohibiting the appearance of "three blind judges"and "dancer-judges", finally settling such judicial cancers as corruption and unfairness in judicial practices. The dissertation firstly defines the concept of system of selection of judges, then by the inspection of the history of system of selection of judges in our country and the foreign systems of selection of judges, the author holds that there was no regulated system of selection of judges in the history of our country, while foreign systems of selection of judges have reached the degree of modernization, so the construction of system of selection of judges in our country shall consider these positive and passive experiences; then the dissertation tries to analyze the disadvantages of system of selection of judges of our country from the two aspects of qualification and system of selection of judges. Finally the dissertation puts forward the basic idea and specific measures to perfect the system of selection of judges in our country. The author holds that we shall make clear of the purpose, principles, steps, resources of power of system of selection of judges, starting from the national situation, refer to foreign beneficial mature ways and begin the road of selection of judges with Chinese characteristics. The dissertation puts forward the specific measures from such two aspects as the perfection of qualification and mechanism of system of selection of judges in our country.
