Study On Forest Ecological Benefits Compensation In China

At present, the forestry of our country is in the transition period of giving first place from wood production to ecological construction. The construction of forest ecological benefits compensation is an indispensable and important link of sustainable development of forestry. In 1998, clause 2 of article 8 of the revised Forest Law added:"government institute the foundation of forest ecological benefits compensation in order to provide eco-friendly protective forest and the forest for special use , forest planting, cultivation, protection and management."It provide the legal gist to construct the forest ecological benefits compensation for us. Through practicing for 3 years, our centre government formally instituted forest ecological benefits compensation in the 21st, 10, 2004,and decided that the central finance would set apart 20 million yuan to compensate the 4 million mu commonweal forest which is not protected in the district of the project of the crude forest. But there are some problems in the system, such as so small area of the compensated forest, low level of the compensation, less ways of getting fund, incomplete supervision system, the system of the right protection and the right saving, and so on. However, in the angle of environmental law, the study on the ecological benefits compensation is not deep. So it is very important for the theory and the reality to study on forest ecological benefits compensation.Besides preface and conclusion, this paper is about 43,000 words, and divided into 4 parts:The first part defines scientifically what the forest ecological benefits compensation is, based on the basic concepts and theory of environment law, through analyzing the different definitions of ecological compensation and forest ecological benefits compensation between the theory field and practical field: in order to alleviate the interference of the ecology of forest , the states, society, the beneficiary of forest resource and other organizes should compensate the people who have contribute to the resource, and pay for planting ,cultivating, protecting and managing the forest which could provide the ecology benefit, to strengthen the compensation of forest resource by itself.Under the concept of sustainable development and theory of ecology safety, the second part analyzes the theory and reality gist of the construction and improvement of forest ecological benefits compensation.
