Study On The Several Problems Of The Relative Centralized Power Of Administrative Licensing

Like the relative centralized power of administrative penalties, the relative centralized power of administrative licensing is an important part of the relative centralized administrative law enforcement and an important way of deepening the reform of administrative system. At present, the emergence of the relative centralized power of administrative licensing is a new phenomenon in China, so the administrative academia pays little attention on its theory and practice which results in special and comprehensive research. Therefore, the author attempts to do a systematic research on the relevant problems to the relative centralized power of administrative licensing and hope it will be a credit to later research on this subject.This thesis consists of three parts. The first part analyzes the system of the relative centralized power of administrative licensing. Firstly, it gives an introduction of the theory by interpreting the legal meaning of the relative centralized power of administrative licensing and making a comparison of relevant concepts. Secondly, it makes a systematic analysis and checks the present cleaning-up of the present administrative licensing projects in the field of law enforcement, which lays a foundation for the establishment of the system of the relative centralized power of administrative licensing discussed later. The second part talks about the systematic background of the relative centralized power of administrative licensing from three aspects: the establishment of rule of law, the reform of governmental agencies and the regulation of administrative law enforcement. The third part explores the realization of the relative centralized power of administrative licensing and puts forward that at present the relative centralization of the power of administrative licensing should be performed in two periods. In addition, this part discusses the supervising system of combining inner self-discipline and outer supervision.
