On Peasants' Right To Receive Education And Its Protection

Although peasants'right to receive education has been ensured by constitution, in practice, peasants'right to receive education has been treated unequally seriously. Right to receive education is closed related with the other rights, and also one of the most ways to develop oneself. Especially in the period of social transformation, peasants'right to receive education becomes more and more important. This thesis is divided into three parts.In the first part, the author introduces the basic theory of right to receive education. The author believes that right to receive education is a basic right, which is guaranteed by government to provide equal educational conditions and opportunities, to develop personalities, talents and abilities by learning in various schools. The right to receive education, as a basic right of human being, is the responsibilities of a country, which is entrusted both by the constitution and the international law. The obligation of compulsory education primarily refers to the obligation of country and society, which guarantee the right aged person to receive education and remove all the barriers. Compulsory education is the obligation of all the countries, societies, families and schools, and being free of charge is the common ground all over the world. However, at present, the compulsory education in our country is not free of charge completely, and the contradiction between different laws is rather sharp. Besides that, the system of investment to education is also not beneficial to compulsory education, especially in rural areas.The equality of education, as a social ideal and a principle of law, can be divided into two fields, that is, compulsory education field and non-compulsory education field.
