Research On Our Administrative Guidance System

As an offspring of rapid development of modern market economy and the tide of administration democratization, administrative guidance has been attached more importance and more operation, which brings into play its special administrative management effect. It has increasingly become an important administrative management measure, administrative manner and significant function, and a vital research object of modern administrative law. In developed countries, administrative guidance has turned into crucial administrative management means, which contributes to each country's economic development. In our country, administrative guidance has played more and more important role in governmental macroscopical control and social management. However, owing to different kinds of reasons, the research force of administrative guidance in our country is not powerful enough, and it is not applied positively enough by practical affairs executers with the support of essential theory. No matte academe or in the field of practical affairs, there are still many people know little about administrative guidance, and some even have an attitude of entirely negative. In this case, under market economy in our country, it is obviously goes against strengthening, improvement and nomocracy realization of administrative guidance. It urgently needs further study and fulfillment.Any system requires a certain set of theory instruction for its existence and development. So does administrative guidance. Therefore, this article discusses its theoretic basic from the area of nomology, economy and traditional culture of our country. Meanwhile, it gives a mental introduction to administrative guidance by analyzing its basic theoretic knowledge such as concept, character, etc. In addition, by comparison the writer reviewed legislation and application status in practical affairs in developed countries and regions, and analyzed the history of administrative guidance and its existed problem. Finally her point of view is that in order to consummate our administrative guidance, it should be that implement principle set as a pre-control measure, procedure bylaw set as mid-control measure, and almsgiving system as after-control measure.
