A Philosophical Analysis On Technology Laws

The level of development of modern technology has already become a sign of national strength. The rise of technology law results from the development of both technology and law, and meanwhile it is an organic combination of the two. How to solve the new legal problems caused by the development of technology so as to enhance current jurisprudence and establish new laws? How to strengthen the legal system so as to guarantee and promote the development of technology? The abovementioned questions are of great practical value and they deserve an in-depth study and an appropriate solution.First, this article introduced the basic concept and the interrelation of the science and the technical.And it outlined the necessity and the feasibility of technical legislation. Because of the development of technical and the weaken restriction function of technical morals in the technical work, urges the technical legislation to become the urgent question to face us. Then it take the Marxism science and technology view theory as the instruction analyzed the technical legislation to promote the technical development.Next, this article analyzed and elaborated the theory basis of technical legislation, specially analyzed the technical legislation to recover the technical morals flaw present situation and to impetus morals reconstruct function from the fusion of moral and law.Finally, this dissertation points out that compared with developed countries, legislation in China is still far from perfection, the legislation of technological innovation, high technology, and the conformation to the international conventions being the weakest. In addition, this dissertation presents a thorough analysis of the reason on the imperfection of the legislation. It argues that under the condition of new technological innovation, it is imperative to enhance the legislation of technology laws with the aim to provide a comprehensive and solid legal guarantee for a stable and enduring development of technology in China. It also puts forward several legal countermeasures to accelerate the development of technology in China.
