On Reconstruction Of People's Jury System In China

In this paper, the author reasonably describes and comments on the values and functions of the jury systems by comparing the origin and development of the people's jury system with the western ones, and then concludes that it is necessary to establish people's jury system in our country. This paper gives a close analysis of the disadvantages and problems of the jury system and the viewpoints of reserving or abolishing the jury system of different experts. The practicality of improving the people's jury system is also proved by analyzing it in two scopes of legislature and judicature in our country .The paper is divided into four parts: Part one, the origin and development of the jury system in the western countries. Part two, the history and present situation of people's jury system in our country and the disadvantages of people's jury system in practice of legislature and judicature. Part three, the values and functions of the people's jury system. Part four, suggestions of improvement of people's jury system in constitutional legislation and reform and improvement of legislation.
