With the stage of bank market opening, the status and influence of the foreign bank have become increasingly prominent. As the special nature of the banking, the market access of foreign banks has been a universal concern. In the legal system of the World Trade Organization, the market access is one of the most important issues. Although compared with the previous, the supervision and regulation system over the market access of foreign banks in China has already made great progress, the financial environment is complex, and for the relative stability of the legislative council, there are still some problems in the market access on foreign banks in the legislation.This paper bases on the rules of the banking market access of the WTO, introduces the scope of foreign banks, the market access and the meaning and significance on the market access of foreign banks, meanwhile it learns the experiences from other countries and international organizations, discusses three basic principles on the market access of foreign banks in common use around the world-wide, the purpose of the article is that by studying our problem to make a legal way for giving an effective regulation on the market access of foreign banks, and making full use of WTO rules to achieve healthy and rapid development for Chinese banking. The paper also points out that we need establish clear objectives and principles for supervision over the market access of foreign banks in China as guidance for building a reasonable system of legal norms and regulatory framework for the system, improves and perfects the existing regulation rules, considering not only the WTO rules but also our economic and financial level, improve and adjustment the supervision rules on the market access of foreign banks in the forms of organization, access conditions, and restrictions related to the scope of specific rules and the international cooperation to make an effective and continuing regulation for promoting the stability of the domestic financial market development.
