| Because of the particularity of technology, the attitude of people to technology legislation is pragmatic from the day when technology law is born. But any law department must have legislation system. Technology legislation has to be one-sided if it is short of systematic legislation system. It is harmful to the development of technology law as a law department.This article has the establishing of technology legislation system in china in mind, analyzes the inadequate of the internal and overseas study about technology legislation system, says the unique view. Fist, it makes the connotation and extension of technology law clear, impels the technology law separating from the standard of traditional law department dividing, deficits that which legislation is technology legislation. Second, it gets the value confliction of technology legislation, makes it as the link, lets the technology law integrate a unified whole. Third, says the different between technology legislation system and technology law system, establishing the technology legislation system not be limited to the simple summaries of the existing law but find the regular between the existing legislation to fund the technology legislation orbit for the future technology legislation, making the past, existing and future technology legislation in China as a whole to study and master. Fourth, on the basis of the analysis above, according criticizing and assimilating the existing view, it divides the technology legislation system into four parts: the technology basic law, the technology organization and staff law, the synthetical technology law and the technology specialty law.
