Study On Administrative License Hearing Of China

As the core of administrative procedure and product of modern democratic politics, system of administrative hearing has been widely admitted in the procedure of making policy and enforcing law. China has established the basic regulations of it in the Punishment Law of PRC, the Price Law of PRC, the Legislative Law of PRC and Administrative License Law of PRC, especially in the Administrative License Law of PRC, which is stipulated most comprehensively. It can say, Administrative License Law is an important administrative procedure law, which holds great importance to establish an unite Administrative Procedure Law of PRC. The paper conducted in-depth and detailed discussion to the existing law on administrative license hearing of China. On the basis of the existing collection of 20 ministries regulations, government regulations on administrative license hearing, with the hearing procedures theory, the paper explained the concept, features and meaning of administrative license hearing. The paper focused on the analysis of China's administrative license hearing in the scope of the hearing, stakeholders, the hearing moderator and hearing records in the provisions of its shortcomings, and made a perfect proposal.
