In recent years, as administrative Litigation arising from student management in higher schools keeps increasing, student management in higher schools should be brought under the oversight of administrative law, in the hope of effectively regulating the administrative power of higher schools and protecting the fundamental rights of students, and the current management trouble should be resolved through administrative law so as to further the process of student management legalization in higher school. This paper mainly contains four chapters. Chapter one is about identifying student management in higher school from the perspective of administrative law, establishing higher schools'status as"public interests legal person"and defining the relationship between higher schools and students as"adjusted special power relation". Chapter two is about analyzing the problems and flaws of student management in higher school on the basis of administrative legislation and enforcement. Chapter three is about demonstrating the necessity and feasibility of applying the principles of administrative law to student management in higher school through typical cases. Chapter four is about constructing and perfecting relief system of administrative law for student management disputes from three different levels—appeal system, administrative reconsideration system and administrative litigation system.
