On Female Crime Of Legal Issues And Preventive Measures

In recent years, female crime in the world was rising. As the female crime rate increase, the causes of crime and the control strategy have become the hot subject concerned. Because of their special social harm, the analysis of the main types of female crime can help us to use a variety of means to mobilize all positive factors in society, and to take some preventive measures. This article is from the needs of society and the criminal status quo at home and abroad, to the use of comparison, and the general summary of a combination of methods, so we can solve China's female crime practical problems. In this paper, the status of women in society and female criminal history in the West , an analysis of the current focus of the three types of female crime and its characteristics; the theoretical level of crime from the women's psychological and social factors and so on , they are researched. We hope we can build women's community crime prevention and control system of female crime of social security mechanism.In this paper, there are five parts.The first part is the status quo of female crime at home and abroad to introduce. The article collected data and summed up the crime trends of female in the whole world. From a global perspective, the absolute number and the relative ratio of female crime can not be ignored because of the high growth speeding of it every year. The type of crime is beyond the traditional type and the female crime also has the development trend of diversification. They means that female crime took place in the field of male-dominated crime, and had the rapid expansion; at the same time,the female crime caused direct and indirect harm in society.The second part is to introduce the theories of female crime in Western world. From an analysis of the theories of female crime in the mid-19th century to the early 20th century to the present-day ones, we know there was some wrong views and constructive ones. The study of Lombroso and the Philippines Lee represented that female crime is a biological factor in the outcome of the role of women offenders. They were "fake man" and "natural-born offenders." This view has not been scientific and has great limitations. In the early 20th century to the mid-20th century Western academic study of female crime, the most representative is O ? Pollack and Thomas W ? I ?. Their theories were to a large extent with Lombroso and Philippe's "biological determinism" point of view in the same strain. But in some ways since the 1980s, female crime research can be divided into: modern biology camp; school of modern society; feminist critical thinking, and so on.The third part describes the types of female crimes. From a legal point, understanding the crime is the most simple and convenient. As early as 1933 North American criminologist Jerome. Mortimer and Michael. J. Adler said: "The criminal act is prohibited by criminal law. This definition has the advantage of the greatest possible clarity. At the same time, the number of crime statistics is very clear. "Female crime, as its name implies, that it is the main crime for women to be implemented with the serious social harm. In this part, there are three : violent crimes, sex crimes and property crimes. The focus is on property crimes. In this theft , fraud and bribery are important to be discussed. With a view of the main types of female crime we hope that we have the more comprehensive and three-dimensional characteristics.The fourth part is the analysis of the causes of female crime. From the profound social background, becauses of the complicated family and a variety of reasons, we can explain the nature and internal factors of female crime. In the profound social background, we should focus on the distribution of social resources, the application of social assistance, culture , education and respecting women; in the complex family factors, domestic violence, improper family structure, family education and other issues must not be ignored ; In their own reasons, women's physical and psychological protection should be given the same attention.The five part is a female crime prevention as well as the countermeasures proposed. On women's psychological and physical characteristics, social position and families, the status of women would be improved and we would have some effective prevention of female crime. First, we should protect the rights of women in marriage and family, strengthen social security to promote women's economic independence and increase awareness of women's rights protection; Secondly, we should build a complete anti-domestic violence law, which is perfect to create anti-domestic violence legislation, to strengthen the judiciary Law enforcement agencies to intervene in domestic violence, and female (to violence with violence) criminal acts should be lighter sentence, and we should establish the domestic violence proceedings of the proof system; Finally, we hope the community can achieve a full range of prevention and control mechanisms. Especially, we should eliminate negative phenomena to strengthen the management of the population, to play a perfect role in the community and improve the grass-roots organizations, to safeguard women's rights and improve the legal system.Finally, in recent years with the development of science and technology, female crime is also the type of crime and have the growing diversity of hidden.
