A Discussion On Model For Rural Collective Economy Transformation And Legal Obstacle

The thesis is to study the development of rural collective economy organization from a historical point of view,to fine the origin of currently problem based in deep history background.Pointing out that both the Cooperative and Company Limited by Shares are the effective models for rural collective economy organization in realization of transformation.Also giving a systematic analysis on legal obstacles of collective economy transformation based on constitution,civil law and economic law.The author holds that the collective property possession by members is based on common relationship,putting forward critical on now land system and advices on reform of property rights for collective economy organization. The thesis is divided in five articles:The first introduces some concepts related to collective economy organization.The second describes the development history since 1949 and present situation of rural collective economy.The third shows that both the Cooperative and Company Limited by Shares are the effective models for rural organization in realization of transformation.The forth gives an analysis on legal obstacles of collective economy transformation.The fifth suggests that rural collective economy organization should be reformed.
