On Legal Regulation Of The Garbage Messages

As extension services of communications,cell phone message has brought a lot of convenience to the people.But in the wake of message services,there are a lot of black,yellow and commercial garbage messages.Such telecommunications services has violated the state's laws and regulations,seriously interfered in the daily lives of the majority of mobile phone users,and it's also a violation of civil rights of the mobile phone users.However,due to the lack of relevant laws and regulations, the absence of effective regulation and the law does not explicitly assume responsibility,Once a dispute arises,the mobile phone users is difficult to pass an effective means to protect their legitimate rights.In view of this situation,the author hopes this thesis can make some contributions to the regulation of garbage messages in our country.The paper mainly uses the method of empirical investigation, comparative analysis and value analysis.The methodology is based on dialectical materialism and historical materialism.The first part uses the method of empirical investigation and comparative analysis to classify the garbage messages through the extensive investigations and define the meaning of garbage messages and analyze why so many garbage messages appears.The second part uses the method of chart analysis to discuss the network of mobile phone business as well as the industrial chain.The third part uses the method of value analysis to discuss the holding of tort liability of garbage messages and the bearing of responsibilities.The fourth part puts forward some proposals such as improving the legislation,implementing the true name system on mobile phone and strengthening the social responsibility of the enterprises and so on to regulate the garbage messages. The innovation of this paper is that analyzing the reason why so many garbage messages are produced through extensive research.On the basis of this,discuss the related issues of infringement of garbage messages.The paper also proposes my own opinions on regulating garbage messages on the basis of drawing on successful experience of overseas.
