As a country which possesses four seats in WTO, how China applies the rules of WTO to establish a China free trade area, i.e. a free trade area among China mainland, Hong Kong, Macau and Taiwan, is an issue that must be solved in the condition of the four regions'joining the GATT/WTO as separate tariff areas and equal members, and the dependences of economies are getting stronger as well as China mainland, Hong Kong and Macau's signing of CEPA.The four regions have their own particularities in people, terra and opportunity, and these need better relationships of four regions, in order to take advantage of each other to develop four regions'economies together and bring circumjacent effection, and build up the China's status on global economies. To achieve this goal, owning equal rights and responsibilities,the four region could accord to the 24th article of GATT 1994 and understanding on the 24th article of GATT 1994 or Authorization Article which established in the Tokyo round and the fifth article of GATS which established in the Uruguay round, and use the experience of present free trade area for reference, to establish China free trade area on the basis of CEPA rules.Many barriers would be met through the establishing the four region free trade area, the juristic issue would be the foremost because it's the institutional guarantee for establishing of free trade area and its operation. After reviewing the reality and juristic basis, this dissertation will analyze a series of issues like how the four regions frame the trade agreement and relative laws for free trade area together, modify the relative economic laws which are not consistent with the development of free trade area, and take flexible measures to boost the establishing process of free trade area gradually.
