The Criminal Protection Of Drug Safety

Drug safety is an essential part of patient safety and public health safety. The history of the development of drug supervising and medical development in the world is parallel. With some serious drug adverse reaction events, people aware of the importance of drug safety. Some countries and regions in the world have reinforced the drug administration. Generally, Drug safety is a comprehensive, relative and complicated system.Drug safety produces an effect on public health, life quality, social stability and the long-term development of human. In recent years, the practice shows that some serious drug adverse reaction events have cause harm to public health, and the problem of drug safety have become the focus of public concern. Thus, the legal protection is indispensable for drug safety. At present, the laws for protection include administrative law protection, civil law protection, criminal law protection and the protection from relative laws and regulations. These forms for protection have different characteristics, but they act in synergy for the protection of drug safety. In addition, the criminal law is the final line of defense for the drug safety.In the process of the formation quality of drug, the safety problem of every section which included R&D, manufacture, circulation, usage and supervision would bring drug adverse reaction events. In addition, the business safety in internet environment and the safety of drug information in the circulation are the new blood in the drug monitoring. The author reviews the experiences of criminal protection of drug safety in other countries and districts, including America, British, Japan, Norway, Spain, Poland, Turkey and Taiwan district of China. These countries regulated the drug safety in penal code or specific law, and give emphasis to the adulterant that violate the law. The patterns include punishment against freedom and pecuniary penalty, and some countries even would deprive the offender's vocational right.The author has the subject background of pharmacy management, and six years' working experience in teaching pharmaceutical administration in a university. The originality and innovation of this research is studied on drug safety from the penal standpoint. On the basis of the reality of drug safety crime of our country, the author systematic researches the criminal protection and proposes remedial measures to improve the criminal protection. The author suggests that the connection between the criminal justice and administrative enforcement would be added, establish the qualification standard of products caused cripple and give more publicity.At last, the situation of drug safety was still serious. The research of drug safety is imminence to all of us. The systematic research aims for the criminal protection could be the final line of defense for the drug safety.
