On The Labor Right Of Flexible Employment Group

Since the Reform and Opening-up,the risk of unemployment rapidly expanded in various fields on account of the dramatic changes of economic and industrial structure. At the same time, the whirling financial turmoil had pushed the labors,as a vulnerable group,to the head of curves.The unemployed labors had no choice but to influx into the field of Flexible Employment with the attempt to meet their survival demands.However,due to the current legislation being lack of specific proyisions,it was difficult to find clear legal support to protect the right of Flexible Employment group.In the era of human rights advancing, since the state couldn't provide citizens with cradle-to-grave Social Security,to protect the labors'right should be the basic concept of Service-oriented government.Based on the social status,in the light of Constitutional fragment, this article took the equity of Flexible Employment as the research object. Comprehensively using the knowledge of Constitution,Jurisprudence and Departmental legal subjects,as well as the research methods of inductive analysis,enumeration and comparison,the article firstly made a brief introduction to the theory of Flexible Employment,analyzed the multiple difficulties of Flexible Employees and the absence of Relief System in the present stage in detail.Then,the article put forward the bottleneck constraints of institution.Finally,on the ground of academic research on the right-protection of vulnerable group,this article brought up a whole frame of equity-protection which was constituted of the social system reform. advancing legislation,concurrent steering mechanism and post-relief system.The article attempted to do some intellectual thinking and provide some building advice for the special group's protection of their labor rights.
