A Survey Of Urban Resident's Petition Status In Guangxi Autonomous Region

In china, the petition system with chinese characteristics legal culture contains a democracy, the value of harmony and rule of morality demands, consistent with the political and cultural traditions and national institutional arrangements of political psychology. After the founding of new china, the petition system plays an important role in closing the party and government with the masses, consolidating the party's ruling basis, reflecting the social conditions and public opinion, promoting scientific and democratic decision-making, coordinating the interests relationships, protecting the mass's legitimate rights and interests, resolving social conflicts and maintaining social stability. In the new time, the petition work in the historical process of building a socialist harmonious society and building a moderately prosperous society, highlighted the "indispensable, irreplaceable, can not be ignored" status. At present, many scholars believe that the difficulty of building a socialist harmonious society is in rural areas, and emphasis on a study about the petition issues in countryside. The author believes that constructing a harmonious cities as well as important, and the problem of urban petition should not be overlooked, so this is paper is studying about petition issues in urban residents. This paper was based on the sociological theory, with city residents in C city of Guangxi province for the object, classified the petition incident by the nature of their contents that occurred from 2004 to 2008 years, and sorted out different types of petition issues, for further analysis, revealed their status, looked into their causes, and proposed some advices to solve petition issues. Be arm to improve the work of petition, solved social problems, alleviated social contradictions, maintaining social stability, give a service for building a socialist harmonious society and building a well-off society. The Body consists of three parts:The first part, clarified the background of the study about petition issues, toll the uses of this study and it's methods; introduced the status of petition issue which domestic and foreign scholars who studying on, and made a review; introduced the social functions theory, social confliction theory and other major theories; defined Some important concepts in the study and specified the classification of petition issues; on the basis of previous research, strived to be innovative the study, pointed out the difficulties that confronted with.The second part, first of all, made a simply definition to the studying objection and the studying total. Then, according to the studying needs, took the information that the total reflected into different types of the petition issues. Finally, transformed all the petition issues into the corresponding codes and sent they into SPSS 15.0 software and did analysis, to express the quantitative characteristics of the petition issues and it's mainly aspects, and showed the situation of petition that had been occur in the C city within a certain period. The situation including those contents:the petition profiles that in a whole city and in other areas; analyzed five categories of petition issues (they are urban and rural construction, labour and social security, politics and laws, organization and Personnel, Land and resources) about their distribution and internal manifestations. Accordingly, made these following conclusions:one, the issues on urban and rural construction, labour and social security, politics and laws, organization and personnel, land and resources are prominent but difficult to solve; the another one, at presents, the petition situation in the C city is remain serious, besides the hardly social pressure that these five main aspects to make, other petition issues may evolve into a new hot spot in future, such as environmental protection.The third part, using the relevant theories, respectively, discussed these five major complaint issues:urban budding remove, social insurance, complaints concerning law and litigation, reform of the stated-owned enterprise and land expropriate, explained the representation of problem, emphasize analyzed the causes, and put forward some proposals to solve the problem. In addition, to give a brief analysis for minor petition issues. By analysis, the causes of the urban budding remove issues is the effects of urbanization, poverty problems, etc; the causes of the Social Insurance issues is the social insurance system was lag, government misconduct, etc.; the causes of the law and litigation issues was petitioner reasons, law enforcement authorities, etc; the causes of restructuring enterprise was system issues, placement issues; the cause of land expropriate issues is urban and rural structure and the household registration system has drawbacks. The author believes that to solve the petition issues, the key is discerning the nature of their causes. Not only the petition departments should work hard in practice, but also to strengthen theoretical research, the scholars should also be strongly involved in research letters and visit.
