The financial crisis caused by the sub-prime crisis of U.S. has swept the world, and China is no exception. In China, the low import and export manufacturing enterprises of coastal areas has been hit in the first place. In order to help coastal areas shake off the impact of financial crisis, our Government has proposed a strategy that manufacturing industry in eastern coastal areas shift to the mainland and the coastal areas commence industrial-upgrading. In 2009, the found of the first inland Bonded Port Area of China who is also the only one by now - Chongqing Cuntan Bonded Port Area - is a response to this strategy. The country grant the Chongqing Cuntan Bonded Port Area high expectations, and its predominant location does not allow its ordinary. However, the operation of any program requires stringent procedures,that is the rules, the operation of the Bonded Port Area is the same, so does the Chongqing Cuntan Bonded Port Area given high expectations .There have been thirteen Bonded Port Areas of China since its inception in 2005, but their development varies greatly, the key problem is the different operation specifications of each Bonded Port Area. Compared with Foreign Free Trade Zone, the difference is the sequence of the legislation and the establishment of area: the former generally establish its area after formulating its legislation, but our country is on the contrary. The purpose of this paper is to emphasize the importance of legislation of the Chongqing Cuntan Bonded Port Area and puts up with the issues that we should pay attention to in the legislation, administration system and customs regulatory regime of the Chongqing Cuntan Bonded Port Area, as well as solutions on the basis of comprehensive analyzing the related concepts, legal nature, existing legislation of the domestic Bonded Port Area, and that of the Foreign Free Trade Zone.This first part of this paper mainly introduces the concept, legal nature,Current situation of China's Bonded Port Area, as well as the characteristics of Chongqing Inland Bonded Port Area which are different from other Special Customs Surveillance Zones and Foreign Free Trade Zone. In my opinion, legislation should not only have principles but also concrete analysis of specific issues. So,only after clearly analyze the characteristics of Chongqing Inland Bonded Port Area which are different from other Special Customs Surveillance Zones, we are able to formulate legal system which is suitable for the Chongqing Cuntan Bonded Port Area targeted. Therefore, this part is essential.The second part sorts out the existing legal system of our Bonded Port Area. Owing to Chongqing Inland Bonded Port Area has something in common with the Bonded Port Area: some principles in legislation is in common, so is some legal dilemma. So it is absolutely necessary to sort out the existing legal regime of our Bonded Port Area.On the basis of the second part and its characteristics, the third part summarizes the legal dilemma that Chongqing Inland Bonded Port Area faces. I choose three of the dilemmas: legislative dilemma and dilemmas in administration system and customs regulatory regime.This fourth part summarizes the related legal system more mutual of the Free Zone, servicing for the ultimate purpose of this paper. In terms of learning experience, China is neither a "take-ism" country, nor a isolated one, and she insist that good experience certainly worth learning. Foreign Free Trade Zone produced earlier than the Bonded Port Area in our country, and her legal system is also more mutual. So in the establishment of legal system in line with our actuality, we should learn from Foreign Free Zone selectively.Part V is the most general purpose of this article - give some suggestion about constructing the legal regime of Chongqing Inland Bonded Port Area. This part mainly considers the third part of this article which proposes the legal dilemma of Chongqing Inland Bonded Port Area, and combines with other parts of this article, and at last put forward some more detailed legislative proposals.In general, this paper uses a research method called comparative analysis, and the key detail is also illustrated. All of these demonstrate that this paper strive to clearly describe the characteristics of Chongqing Inland Bonded Port Area, to comprehensive summary its legal dilemma, to accurately put forward legal advice in need.
