Legal Environment On The Construction Of Professional Basketball Research

One of the characteristics of China socialist economy is the implementation of the legal system, so our professional basketball during implementing the process of marketization should also follow this trend. In the reform process because of interests plural main body and basketball practitioners legal awareness of scarcity, professional basketball is bound to face a large number of economic behavior and legal issues in the course of the market, leading to many contradictions and law-related problems, what is worse, some individual problems directly damage the interests of the parties. Therefore, establishing the legal system of professional basketball is to guarantee powerfully the fast-forward reform and healthy development of professional basketball. At present, China scholars on the legal system of multi-professional basketball is to present the situation of dispersion .This article takes general sociology and the corresponding legal system , with the integrated use of legal theory and various specific legal knowledge, in combination with the concrete practice of the professional basketball change in our country, to discuss the professional basketball environment and present situation, the foreign professional basketball development situation and China's legal professional basketball problems in a more comprehensive and detailed way. From the macroscopic angle, it explores the legal environment of professional basketball in China and proposes specific measures and the development of countermeasures. The main conclusions: Firstly, with the legal system of the status of professional basketball as a starting point, this article is on the basis of previous studies to further theoretical analysis, which clearly shows that if our country professional basketball wants to develop healthily under China socialist market economy, we should first establish a comparatively sound professional basketball regulations system, so that the operators of professional basketball clubs are in the legal system and systematic legal management systems; secondly, according to the analysis of the current sports management mechanism, we know that it can not fully adapt to China socialist market economy development, and it has certain constraints for the development of professional basketball, so it requires some institutional adjustments accordingly. For example, in order to strengthen the administrative functions of the CBA, we can play down its economic functions in practice and straighten out the relationship between the Chinese Basketball Association and its subordinate members; Thirdly, it is necessary to establish Professional Basketball League of coalition nature of the organization, with the implementation of market-oriented and entrepreneurial mode of operation, which has an independent legal person status; Fourthly, our country already has legal system to build the conditions of professional basketball, with the practice of professional basketball, sports legislature should gradually develop and improve the management of professional basketball and regulations, mainly in legal sense, legal norms, legal organizations, legal acts and legal supervision; Fifthly, the management of professional basketball still has insufficient regulatory side, for example, the introduction of the regulations need to include on the flow of talent management requirements, athletes and professional basketball personal insurance and professional basketball anti-unfair competition aspects of regulatory system.
